The Florida House is ready to take an approach backed by prosecutors and Attorney General Pam Bondi.
On Wednesday, the House is slated to take up a bill that would revamp the state’s death-penalty sentencing system.Lawmakers are hurrying to make changes after the U.S. Supreme Court ruled the current system unconstitutional because it gives too much power to judges instead of juries when they sentence defendants to death.
Both the House and the Senate agreed on a key part of addressing the Supreme Court ruling. Jurors should be required to unanimously agree that at least one “aggravating” factor exists before a defendant can be eligible for the death penalty.
Do you think the 2nd Amendment will be destroyed by the Biden Administration?(2)
On the flip side, the House and Senate are divided as to whether jurors should be required to be unanimous in recommending to judges the death sentence should be imposed.
The the past, Florida has only required a majority recommendation.
