In Florida there has been concerns about First Amendment rights and public health as an opponents lawsuit aimed at a controversial Florida law which restricts doctors from asking about a patients’ gun ownership has reached the full federal appeals court.
Last month, the 11th U.S. Circuit Court of Appeals upheld the constitutionality of the 2011 law. The 2-1 ruling was a victory for 2nd Amendment supporters and a defeat for the medical advocates.As reported by News4Jax, attorneys for the opponents filed documents on Tuesday asking the full appeals court to hear the case. The documents also stated the opponents have intentions of going to the U.S. Supreme Court if they need to.

(The law), on its face, restricts professional speech on the basis of its content, and disagreement with a particular viewpoint is what spurred its passage.
The law in question prevents doctors from entering information about gun ownership into medical records because the physicians knowing the information is not “relevant” to patients’ medical care or safety or safety of others.
It also prevents doctors from asking about gun ownership unless the doctors believe in “good faith” that the information is relevant to medical care or safety. In addition it prevents doctors from discriminating against patients or harassing them because they own guns.
