President Obama is going to seek an emergency court order allowing him to move forward with his executive action on immigration.
Officials at the Department of Justice (DOJ) will seek the emergency stay early next week. The stay would essentially undo Texas federal judge, Andrew S. Hanen’s temporary injunction.Hanen ruled in a case that was brought before him by 26 states who did not feel the president had the constitutional authority to put such programs in place. Also, by Obama doing so their states would be forced pay exorbitant new costs for the legalized immigrants.
If the emergency stay is granted the government will be allowed to restart the executive programs that were halted last week. The stay would also shield millions of undocumented immigrants from being deported.

The administration will also file an appeal of the temporary injunction.
White House press secretary, Josh Earnest said:
We will seek that appeal because we believe when you evaluate the legal merits of the arguments, that there is a solid legal foundation for the president to take the steps he announced last year to help reform our immigration system.
On the other side, Republicans are trying to stop Obama’s executive actions. Senate Republicans are trying to pass a funding bill for the Department of Homeland Security which includes a rider that will defund Obama’s immigration reforms. Senate Democrats keep blocking the bill which could possibly lead to a partial government shutdown next week.
