Florida Governor Rick Scott has taken off the gloves in his ongoing “lucha libre” with the embattled Department of Veteran’s Affairs, as he has just filed a lawsuit against the VA for “failing to comply with minimum standards of patient safety” through Florida’s Agency for Health Care Administration (AHCA).
The suit names the AHCA ,veterans Nancy Hall and Roland Dickerson as the Plaintiffs.“I am committed to righting the wrongs experienced by Florida’s veterans at the hands of the federal VA, that has repeatedly failed to comply with minimum standards of patient safety. The suit outlines why AHCA should be afforded access to inspect VA hospitals.

About a month ago Governor Scott broke the news about the unknown fact that state healthcare inspectors were being turned away from VA medical facilities. The inspectors were merely trying to look into the current state of healthcare that veterans were receiving at the facilities.
Through this action, the State of Florida, Agency for Health Care Administration (“AHCA”), and veterans Nancy Hall and Roland Dickerson (collectively, “Plaintiffs”) seek to compel the United States Department of Veterans Affairs (“VA”) and Sloan Gibson, Acting Secretary of the VA (“Secretary”; collectively, “Defendants”), to submit to external inspection and oversight of VA hospitals by AHCA, an objective, independent governmental authority.
2. Upon information and belief, as a direct consequence of Defendants’ refusal to submit to external oversight, Defendants have repeatedly failed to comply with minimum standards of patient safety in VA hospitals within the State of Florida. As a result, Plaintiffs Hall and Dickerson, as well as other veterans and their family members eligible for services at VA hospitals, have been deprived of fundamental rights regarding standards of care, guaranteed by the VA’s own Patients’ Rights, 38 C.F.R. § 17.33, and attendant equal protection and due process guarantees of the Fifth Amendment to the United States Constitution (Read the suit here)
The U.S. House of Representatives has passed Congressman Jeff Miller’s (R-FL) VA reform bill, an now the Senate has agreed work within the parameters of Senator Rubio’s own version of the House VA reform bill.
