Attorney Michael Lambert is seeking to “unseal” affidavits that were submitted to a Flagler County judge in connection with a grand jury proceeding assigned to Harry Shorstein by then Governor Jeb Bush. Those affidavits reportedly set forth and outlined professional and prosecutorial misconduct by Shorstein and his assistant, Melissa Nelson.Lambert stated:
I recollected a lengthy proceeding I was involved in with then ASA Melissa Nelson in 2006-2007. It resulted in a grand jury Presentment . ASA Melissa Nelson was designated as an assigned ASA by SA Harry Shorestein, her boss. After much litigation, the Presentment, which remained under seal throughout, was Expunged and Repressed because of the prosecutorial abuses that ran rampant throughout the entire process!

At the time then SA Harry Shorestein was assigned by Governor Bush to investigate alleged inmate abuse at the Flagler county jail. Melissa Nelson and another assistant were given the assignment to conduct the assignment. Lambert was another attorney involved in the case.
He said:
After having spent nearly $750,000 of taxpayer $ in all the proceedings, a 7th circuit trial court Expunged and Repressed the Presentment finding multiple examples of prosecutorial abuse, even from the very beginning as SA Shorestein converted the assignment into an investigation of how SA Tanner’s office was investigating the Jail- not something permitted or sought by the governor’s assignment.
Lambert went on to state the behaivor he witnessed was very unprofessional:
I have appeared as a prosecutor in many grand jury proceedings, appeared as counsel for witnesses in others, and even testified in some other grand jury cases and I can tell you, without ANY hesitation that the abuses I witnessed by these prosecutors, in these proceedings ,were the most egregious, demeaning, vulgar , unprofessional ,and despicable that I have ever witnessed.

His office is also trying to get an emergency hearing so it can be decided before the upcoming election on Tuesday.
Nelson is running against incumbent Angela Corey and Wesley White to become the State Attorney for Duval, Clay and Nassau Counties.
